These terms and conditions of Use, and Privacy Policy, regulate the use according to Law 34/2002 of July 11 on Information Society Services and Electronic Commerce of the WEBSITES: https://www.bohodot.es, of which, POOLSEA, SL, hereinafter, BOHODOT, with NIF: B-67560524, Mercantile Registry of: BARCELONA, Volume: 47193, Folio: 216, S8, Page: B 544289, with Registered Office at: GERMA JULI, 1, 1º1ª, Postal Code: 08911, City: BADALONA, Province: BARCELONA, is the owner.

1. Information about the website

Through its WEBSITE, https://www.bohodot.es, of which it is the owner and administrator, BOHODOT is an online store selling swimwear, bikinis, hair scrunchies, women's clothing, and accessories.

1.1 Advertising on the website

The Website: https://www.bohodot.es, may host advertising or sponsored content. Advertisers or sponsors are solely responsible for ensuring that the material submitted for inclusion on the Website complies with the laws that may apply in each case. BOHODOT will not be responsible for any error, inaccuracy, or irregularity that the advertising or sponsor content may contain.

2. Website availability

The website administrator will do everything possible to resolve all doubts and requested procedures for all its USERS/CUSTOMERS as quickly as possible upon the demand of the inquiries.

However, occasionally, and for reasons difficult to control by the website administrator such as human error or incidents in computer systems, it is possible that the final speed served to USERS/CUSTOMERS may differ from the initial plan set by the website administrator to satisfy USER/CUSTOMER orders.

In the event that the sales management is not available or the purchase process cannot be completed after the order has been placed, the USER/CUSTOMER will be informed by email of its total cancellation.

6. Our web responsibility

The website administrator assumes no liability derived from, including but not limited to:

• The use that USERS/CUSTOMERS may make of the materials on the WEBSITE or linked websites, whether prohibited or permitted, in violation of the intellectual and/or industrial property rights of the WEBSITE content or third parties.

• Non-operability or problems in the email address provided by the USER/CUSTOMER for sending the order confirmation.

In any case, the website administrator undertakes to solve any problems that may arise and to offer all necessary support to the USER/CUSTOMER to reach a quick and satisfactory solution to the incident.

Likewise, the website administrator has the right to carry out, during defined time intervals, promotional campaigns to encourage the registration of new members in its online sales service.

The website administrator reserves the right to modify the conditions of application of the promotions, extend them by communicating appropriately, or proceed to the exclusion of any USERS/CUSTOMERS from the promotion in the event of detecting any anomaly, abuse, or unethical behavior in their participation.

7. LSSI-CE Compliance and Data Protection Certificates

BOHODOT, owner of the website: https://www.bohodot.es, complies with current Data Protection regulations GDPR-EU-2016/679, LOPDGDD-3/2018, with LSSI-CE-34/2002, and Law 9/2014, General Telecommunications, and is advised on these regulations by GRUP QUALIA, for which it is granted certificates in digital image format to display on its website.

7.1 Intellectual and Industrial Property

The website administrator holds all rights to the content, design, and source code of this website: and that of the WEBSITE, and, especially, including but not limited to, the photographs, images, texts, logos, designs, trademarks, commercial names, and data included on the web.

USERS/CUSTOMERS are warned that these rights are protected by current Spanish and international legislation relating to intellectual and industrial property, Royal Legislative Decree 1/1996, of April 12 and subsequent modifications. Directive-EU-2019/790 of the European Parliament and of the Council of April 17, 2019, on copyright and related rights in the Digital Single Market.

Without prejudice to the above, the content of the WEBSITE is also considered a computer program, and therefore, all Spanish and European community regulations in force on the matter also apply.

Furthermore, the copying, reproduction, adaptation, modification, distribution, commercialization, public communication, and/or any other action that involves an infringement of current Spanish and/or international regulations regarding intellectual and/or industrial property is strictly prohibited, as is the use of web content without prior express written authorization from the administrator.

8. Nullity

In the event that any clause of these terms and conditions of use is declared null, the remaining clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these terms and conditions.

The website administrator may choose not to exercise some of the rights and powers conferred in this document, which will in no case imply a waiver of them unless expressly recognized by the website administrator or prescription of the corresponding action in each case.

9. Applicable law and arbitration

These terms and conditions of use are governed by applicable Spanish legislation on the matter. To resolve any controversy or conflict that may derive, the parties submit to the jurisdiction of the courts of BADALONA, the city of origin of the entity BOHODOT, owner of the WEBSITE, unless the law imposes another jurisdiction.

By Law 7/2017, of November 2, in its Article 40.5, by which Directive 2013/11/EU of the European Parliament and of the Council of May 21 is incorporated into the Spanish legal system, in its Article 5.1, relating to the alternative resolution of consumer disputes: Online dispute resolution platform.

10. Data protection and privacy policy

USERS/CUSTOMERS undertake to browse the WEBSITE and use the content in good faith.

In compliance with the provisions of the General Data Protection Regulation-EU-2016/679, LOPDGDD-3/2018, LSSI-34/2002, and Law 9/2014, General Telecommunications, we inform you that completing any existing form on the WEBSITE: https://www.bohodot.es, or sending an email to any of our mailboxes implies acceptance of this privacy policy, as well as authorization for the website administrator to process the personal data you provide, which will be incorporated into the file owned by the Data Controller and/or website administrator.

In accordance with current legislation on data protection, the website administrator has adopted security levels appropriate to the data provided by USERS/CUSTOMERS and, furthermore, has installed all means and measures at its disposal to avoid loss, misuse, alteration, unauthorized access, and extraction of the same.
